1. Agreement to these Terms

These Terms of Service ("Terms") govern your access to and use of websites operated by Mythic Gaming LLC (including mythicgamingllc.com and mythicgathering.com), our mobile applications, tabletop tools, event and league features, store and community tools, and related offerings (collectively, the "Services").

Mythic Gaming LLC ("Mythic Gaming," "we," "us," or "our") is based in the State of Idaho, United States. By accessing or using the Services, you agree to these Terms and to our Privacy Policy.

If you do not agree, do not use the Services. Product-specific terms (such as app store end-user license agreements) apply to the extent they do not conflict with these Terms.

2. Eligibility

You must be able to form a binding contract in your jurisdiction and meet any minimum age required by applicable law or your app store (typically at least 13, or higher where required).

If you use the Services on behalf of a store, league, event host, or other organization, you represent that you have authority to bind that organization.

3. User accounts

Mythic Gaming is introducing optional and required user accounts across the Services. Some features—including event discovery, registration, league participation, store or host tools, and synced preferences—may require an account. Other features, such as standalone life-counter use in Mythic Life Counter, may remain available without an account unless we state otherwise in the app.

Creating and maintaining an account

When you create an account, you agree to:

• Provide accurate, current, and complete information
• Keep your profile and contact information up to date
• Maintain the confidentiality of your password and login credentials
• Accept responsibility for all activity that occurs under your account
• Notify us promptly if you suspect unauthorized access (see Contact section)

One person, one account

Unless we expressly allow it (for example, separate organizer or store administrator roles), you may not create multiple accounts to evade restrictions, manipulate events or standings, or abuse the Services.

Account security

You must not share your account credentials with others or allow anyone else to use your personal account. We may offer sign-in through third-party identity providers; their terms and privacy policies also apply to that sign-in method.

Suspension and termination

We may suspend or terminate your account, or restrict access to features, if we reasonably believe you violated these Terms, created risk for other users or organizers, or are required to do so by law. You may stop using the Services at any time. Account deletion requests are handled as described in our Privacy Policy.

Information associated with your account may include profile details, event registrations, match results, league standings, preferences, and communications with support. How we collect and use that information is described in our Privacy Policy.

4. License to use the Services

Subject to these Terms, Mythic Gaming grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal or authorized organizational purposes, unless we expressly authorize otherwise in writing.

You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract source code from the Services except as permitted by law.

5. Virtual goods, unlocks, and in-app purchases

Optional purchases (including app unlocks, subscriptions, or event-related fees where offered) are completed through the Apple App Store, Google Play Store, Stripe, or another payment provider we designate.

Mythic Gaming LLC does not directly process payment card numbers for store purchases unless clearly stated at checkout. Billing, receipts, and refund requests for app store purchases are handled by the platform where you bought, subject to that platform's terms.

• Virtual items, unlocks, and digital content have no real-world cash value outside the Services
• They are non-transferable and licensed, not sold
• We may modify, rebalance, or discontinue them

Except where required by law, purchases may be non-refundable through the applicable platform.

6. User conduct and acceptable use

You agree not to misuse the Services, including by:

• Violating applicable laws or third-party rights
• Harassing, threatening, or posting unlawful or infringing content
• Uploading malware or interfering with systems or other users
• Circumventing payment, licensing, security, or access controls
• Using modified or unauthorized versions of our applications
• Manipulating event registration, pairings, standings, or match reporting
• Scraping or automated access except as we expressly permit

We may remove content, suspend accounts, or terminate access for conduct we reasonably believe violates these Terms or creates risk for Mythic Gaming, organizers, stores, or other users.

7. Intellectual property

The Services, including software, art, audio, text, trademarks, and branding, are owned by Mythic Gaming or our licensors and protected by intellectual property laws. Except for the limited license above, no rights are granted.

Feedback you voluntarily provide may be used without obligation to you, except where prohibited by law.

8. Trademark disclaimer

Magic: The Gathering is a trademark of Wizards of the Coast. Mythic Gaming LLC is not affiliated with, endorsed by, sponsored by, or associated with Wizards of the Coast or Hasbro. All referenced trademarks belong to their respective owners.

9. Gameplay, events, and accuracy

Mythic Life Counter and related tools are companions for in-person play. They are not a comprehensive Magic: The Gathering rules reference. You are responsible for verifying life totals, counters, pairings, standings, and event legality.

Mythic Gathering, Mythic Tournament, and connected features may display event information, registrations, or results supplied by hosts, stores, or players. We do not guarantee that every listing, pairing, or result is error-free.

10. Community, store, and event features

When you register for events, join leagues, or use store or host tools, information you submit may be visible to organizers, opponents, or other participants as needed for the feature to work.

Do not post private or sensitive information in public event fields, chat, or comments. Organizer and store accounts must use the Services responsibly and comply with applicable laws and venue policies.

11. Disclaimer of warranties

The Services are provided "as is" and "as available." To the fullest extent permitted by law, Mythic Gaming disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

12. Limitation of liability

To the fullest extent permitted by law, Mythic Gaming and its owners, officers, employees, affiliates, contractors, and licensors will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, event outcomes, or similar losses arising from your use of the Services.

If liability cannot be fully excluded, Mythic Gaming's total liability for claims arising from these Terms or the Services shall not exceed the greater of (a) fifty U.S. dollars (USD $50) or (b) the amount you paid to Mythic Gaming for the relevant Service in the twelve (12) months before the claim.

13. Indemnity

You agree to defend, indemnify, and hold harmless Mythic Gaming from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your account activity, your content, or your violation of these Terms, except to the extent caused by our gross negligence or willful misconduct.

14. Changes to the Services

We may add, modify, or discontinue features, including account requirements, pricing, and connected-play tools. We will describe material account or payment changes through the Services or by updating these Terms.

15. Changes to these Terms

We may update these Terms from time to time. We will post the revised Terms here and update the Last Updated date. Continued use after changes constitutes acceptance unless applicable law requires additional consent.

16. Governing law and disputes

These Terms are governed by the laws of the State of Idaho, United States, without regard to conflict-of-law principles.

Except where prohibited by consumer-protection law, exclusive jurisdiction for disputes rests in the state or federal courts located in Idaho. Where mandatory arbitration applies under an app store agreement, that arbitration may govern instead.

To the fullest extent permitted by law, you waive any right to participate in class actions or class-wide arbitration against Mythic Gaming.

Our collection and use of personal information is described in our Privacy Policy, incorporated by reference.
